Join our dynamic legal team at Hitachi Rail, a global leader in the rail industry.  We are seeking an experienced Litigation Attorney to provide legal support for our complex litigation matters, contract disputes, mediation, and arbitration proceedings throughout North America. As a Litigation Attorney, you will play a crucial role in safeguarding our legal interests and contributing to the resolution of intricate legal challenges.  You will report directly to Hitachi Rail STS USA’s General Counsel of the Americas while working in close collaboration with our senior leadership and global legal and commercial teams. 
 

Key Responsibilities:

  • Manage and direct claims and all other contentious matters including complex litigation, arbitration, mediation, and contract disputes.
  • Manage and collaborate with local outside counsel to coordinate legal strategies and gain insights into the specific nuances of litigation with local transportation authorities.
  • Providing legal support on claims and other contentious matters including settlement drafting and negotiation or in-house supervision of litigation & arbitration.
  • Conduct thorough research, and compose well-structured briefs, statements, pleadings, motions, and draft comprehensive memoranda on case-specific issues and broader legal initiatives.
  • Evaluate cases as part of a team, aiming for efficient and appropriate resolutions.
  • Develop and deliver presentations to internal audiences, keeping them informed about case statuses, litigation trends, and potential reform efforts.
  • Support other elements of the General Counsel and Compliance team as needed, including ongoing tactical and strategic advice and support in general commercial matters and transactions, bids, and risk assessments. 

Education:

Juris Doctor (JD) degree from an accredited law school.

Experience:

  • Minimum of 6 years of legal experience in litigation, preferably with 10-12 years of experience in complex litigation and contract disputes.
  • Experience working on Infrastructure or Construction Projects IS REQUIRED.
  • Trial experience and/or Federal/State judicial clerkship is preferred.

Licenses/Certifications:

Active membership in at least one state bar.

Skills and Abilities:

  • Proven experience in defending and prosecuting complex commercial contract litigation, either in-house or in private practice, preferably involving transportation or infrastructure-related matters.
  • Familiarity and experience handling complex commercial contract negotiations, drafting, and review.
  • Strong oral and written communication skills, including the ability to summarize complex matters.
  • Effective decision-making skills and the ability to manage a diverse case load.
  • Strong at problem-solving and critical thinking, business and financial acumen.
  • Analytical thinking and the ability to consider alternatives based on objective data.
  • Ability to work collaboratively and communicate in a diverse global organization.
  • Any additional language skills, while not required, would be advantageous.
